1. Your Right to Opt Out
Under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), California residents have the right to opt out of the “sale” or “sharing” of their personal information. These terms have broad definitions under California law and may encompass certain data disclosures that go beyond traditional notions of selling data for money.
The CCPA defines “sale” as making personal information available to a third party for monetary or other valuable consideration. “Sharing” refers to making personal information available to a third party for cross-context behavioral advertising purposes, regardless of whether money changes hands. This page explains how these definitions apply to Menu's data practices and how you can exercise your right to opt out.
2. What We Mean by “Sell” and “Share”
Menu does not sell your personal data for monetary consideration. We do not provide your information to third parties in exchange for payment.
However, some of our data-sharing practices with advertising and analytics partners may constitute “sharing” under the CCPA's broad definition. These practices include:
- Sharing device identifiers with advertising networks to measure campaign performance
- Sharing browsing activity on Menu.com with analytics providers for cross-context behavioral advertising
- Using tracking pixels and similar technologies that allow third-party advertising partners to collect data about your interactions with our platform
These activities help us improve our platform and deliver more relevant experiences. However, we respect your right to opt out of these practices entirely.
3. Categories of Information That May Be Shared
The following categories of information may be shared with advertising and analytics partners:
- Device identifiers and advertising IDs
- Browsing and search activity on Menu.com
- General location data (city-level only)
- Order frequency and general dining preferences (aggregated)
Important: We never share your name, email address, phone number, payment information, or precise address with advertisers. The data shared with advertising partners is limited to pseudonymous identifiers and aggregated behavioral signals that cannot directly identify you.
4. How to Opt Out
You can opt out of the sale or sharing of your personal information using any of the following methods:
Online Form
Submit your opt-out request through your account settings. Navigate to Privacy > Do Not Sell/Share and toggle the opt-out preference. This is the fastest method and takes effect immediately.
Email Request
Send an email to privacy@menu.com with the subject line “Do Not Sell/Share Opt-Out.” Include the email address associated with your Menu account so we can process your request.
Global Privacy Control (GPC)
Menu honors Global Privacy Control signals sent by your browser. If your browser or a browser extension sends a GPC signal, we will automatically treat it as a valid opt-out request for that browser. No additional action is required on your part.
Processing Time: We process all opt-out requests within 15 business days. You will receive a confirmation email once your request has been fulfilled. Requests submitted via account settings take effect immediately for new data collection, while historical data sharing with partners is terminated within the 15-business-day window.
5. Cookie and Tracking Preferences
Opting out of the sale or sharing of your personal information also disables third-party advertising cookies on our platform. This means advertising partners will no longer be able to collect data about your activity on Menu.com through cookies or similar tracking technologies.
You can manage your cookie preferences separately using the Cookie Settings link in the footer of any page. This allows you to make granular choices about which types of cookies you accept.
Please note that essential cookies required for core site functionality—such as maintaining your session, processing orders, and ensuring platform security—are not affected by your opt-out preference. These cookies are necessary for the platform to operate and do not involve sharing data with third parties for advertising purposes.
6. What Happens After You Opt Out
Once your opt-out request is processed:
- Your data will no longer be shared with advertising or analytics partners for cross-context behavioral advertising
- You may still see advertisements on Menu.com and other platforms, but they will not be personalized based on your Menu activity
- All core platform functionality remains fully available, including browsing restaurants, placing orders, managing your account, and accessing loyalty rewards
- You can opt back in at any time by visiting your account settings under Privacy > Do Not Sell/Share and toggling the preference back
7. Authorized Agents
You may designate an authorized agent to submit an opt-out request on your behalf. To do so, the authorized agent must provide one of the following:
- Written authorization signed by you, clearly identifying the agent and the scope of their authority
- A valid power of attorney under California Probate Code sections 4000–4465
Menu may contact you directly to verify the identity of the authorized agent and confirm that you have granted them permission to act on your behalf. This verification step helps protect your account from unauthorized changes.
8. Verification
For opt-out requests, only minimal verification is required. We will send a confirmation email to the address associated with your Menu account and ask you to confirm the request by clicking a verification link.
For requests to know what personal information we have collected or requests to delete your personal information, additional verification steps are required. Please refer to our full California Privacy Notice for details on the verification process for those request types.
9. Non-Discrimination
Menu will not discriminate against you for exercising any of your privacy rights under the CCPA or CPRA. Specifically, we will not:
- Deny you access to the Menu platform or any of its features
- Charge you different prices or rates for services
- Provide you with a different level or quality of service
- Suggest that you will receive a different price or quality of service for exercising your rights
You are entitled to the same service quality, pricing, and features regardless of whether you have opted out of the sale or sharing of your personal information.
